Terms of Service

By using the website www.simdss.com ("Website") or the Plugin ("Simulate"), you agree to these terms. If you do not agree, please don't use the Plugin or Website.

1. Limitations

The Plugin and Website are owned by SimDSS. You can use them, but you cannot:

  • Copy, modify, or reverse engineer them
  • Remove copyright notices
  • Try to circumvent usage limits or security features
  • Use them for commercial purposes without permission

If you violate these terms, your access can be revoked.

2. Free and Premium Tiers

Free tier includes:

  • Limited input and output variables
  • Limited simulations per day
  • Limited scheduled runs per simulation

Premium tier includes:

  • 4 input variables and 4 output variables per simulation
  • Unlimited simulations per day (subject to Google API limits)
  • Unlimited scheduled runs (subject to Google API limits)

3. Disclaimer

The materials on the Website or the editor add-on Plugin are provided on an "as is" basis. SimDSS makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, SimDSS does not warrant or make any representations concerning the accuracy, likely results, or reliability of materials on the Website or otherwise relating to such materials.

4. Premium Payments

Beta product notice: The Plugin is currently in beta. Features, limits, and pricing may change at any time. By purchasing premium access you acknowledge that you are using a product that is still under active development and may be subject to bugs, downtime, or changes.

Premium access is granted through third-party payment processors. By paying:

  • You agree to the payment processor's terms
  • Premium is linked to your Google account email - it's not transferable
  • It may take up to an hour or more for premium to activate after payment

Premium purchases are generally non-refundable

At this time, we cannot guarantee refunds for technical issues, dissatisfaction, accidental payments, or else. We will do our best to process any refund requests we receive. Where a refund is approved, the following conditions apply:

  • Refund requests must be submitted within 30 days of the original purchase date.
  • Payment processor transaction fees — up to 5% plus $0.50 USD of the transaction value — may not be returned as part of the refund.
  • Premium access will be revoked upon processing of the refund.

If you dispute a payment or do a chargeback, your premium access will be revoked and you can be potentially blocked from future purchases. We will attempt to process your claims to the best of our ability.

5. Limitations of Responsibility and Liability

In no event shall SimDSS be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Website, even if SimDSS has been notified orally or in writing of the possibility of such damage.

Additionally, in no event shall SimDSS be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • your access to or use of or inability to access or use the Website or editor add-on Plugin;
  • any conduct or content of any third party on the Website or editor add-on Plugin;
  • any content obtained from the Website or editor add-on Plugin; and
  • unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

6. Indemnification

You agree to indemnify, defend, and hold harmless SimDSS from and against all claims, liabilities, damages, losses, costs, expenses, or fees arising from or relating to:

  • your use or misuse of and access to the Website or editor add-on Plugin;
  • any content you submit, post, transmit, or otherwise make available through the Website or editor add-on Plugin;
  • your violation of these Terms; or
  • your violation of any rights of any other person or entity.

7. Guarantees

The Plugin and Website are provided "as is" with no warranties of any kind. We don't guarantee:

  • Accuracy of simulation results
  • Uptime or availability
  • Compatibility with Google Workspace updates
  • Freedom from bugs or errors
  • That premium features will stay the same or continue to exist

You use our services and products at your own risk.

8. Model Data

Model data, including sensitive information such as financial data or other personal information you input into the models you create using our Services is not being collected or sent to external services. However, we do not control the categories of personal information you input into your models. For such model data you are solely responsible for how it is managed and maintained.

9. Revisions or Errata

The materials appearing on the Website or in the editor add-on plugin may include technical, typographical, or photographic errors. SimDSS does not warrant that any of the materials on the Website are accurate, complete, or current. SimDSS may make changes to the materials contained on the Website at any time without notice, but does not make any commitment to update the materials.

10. Changes

We can modify, suspend, or discontinue the Plugin or these terms anytime without notice. Continued use means you accept any changes.

11. Links

SimDSS has not reviewed all of the sites linked to the Website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by SimDSS of the site. Use of any such linked website is at the user's own risk.

12. Governing Law

Any claim relating to the Website shall be governed by the laws of the jurisdiction of SimDSS without regard to its conflict of law provisions.

13. Modifications to Terms

SimDSS may revise these terms of use for the Website at any time without notice. By using the Website, you are agreeing to be bound by the then-current version of these Terms.
